Hosting
The provider of all virtual mashines is Strato AG, Otto-Ostrowski-Strasse 7, 10249 Berlin (hereinafter referred to as "Strato").

Tokens
As soon as you request a token in your software this will be stored on our server's database in an encrypted form. The key to encrypt/decrypt is saved in you local installation 's database (if you are not using the cloud hosted version). The token will only be decrypted on requests (e.g. update fleet telemetry configuration, check the state of the car via Fleet API endpoints, send commands to the car via Fleet API, create a new token using the refresh token,...).
Only the minimum required scopes are requested by the token. You can find details on which scopes are requested by visiting https://accounts.tesla.com/de_de/account-settings/security?tab=tpty-apps
Telemetry
Telemetry data is received via Tesla's Fleet Telemetry server.
Telemetry data is stored in Kafka before it gets transferred to you local installation (if you are not using the cloud hosted version) via a WebSocket connection.
Subscription
We use the payment service provider Stripe for processing payments on our website. The provider is Stripe Inc. (hereinafter referred to as "Stripe").
As soon as you want to create a subscription, you have to create a new user account on our website. For every user a customer ID will be generated on Stripe and this ID will be saved on our server.
No payment information will ever be saved on our server, only the subscription IDs from stripe will be saved. Once per hour the subscriptions from Stripe are synced in our backend to check if you have a valid license.

This Software contains copyrighted material, trade secrets and other proprietary material. You shall not, and shall not attempt to, modify, reverse engineer, disassemble or decompile Solar4Car.com/TeslaSolarCharger. Nor can you create any derivative works or other works that are based upon or derived from Solar4Car.com/TeslaSolarCharger in whole or in part.
Solar4Car.com/TeslaSolarCharger's name, logo and graphics file that represents Solar4Car.com/TeslaSolarCharger shall not be used in any way to promote products developed with Solar4Car.com/TeslaSolarCharger. PK Software Service GmbH retains sole and exclusive ownership of all right, title and interest in and to Solar4Car.com/TeslaSolarCharger and all Intellectual Property rights relating thereto.
Copyright law and international copyright treaty provisions protect all parts of Solar4Car.com/TeslaSolarCharger, products and services. No program, code, part, image, audio sample, or text may be copied or used in any way by the user except as intended within the bounds of the single user program. All rights not expressly granted hereunder are reserved for PK Software Service GmbH.
Limitation of Responsibilty
You will indemnify, hold harmless, and defend PK Software Service GmbH, its employees, agents and distributors against any and all claims, proceedings, demand and costs resulting from or in any way connected with your use of PK Software Serbice GmbH's Software.
In no event (including, without limitation, in the event of negligence) will PK Software Service GmbH, its employees, agents or distributors be liable for any consequential, incidental, indirect, special or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of use, business interruption, loss of information or data, or pecuniary loss), in connection with or arising out of or related to this Agreement, Solar4Car.com/TeslaSolarCharger or the use or inability to use Solar4Car.com/TeslaSolarCharger or the furnishing, performance or use of any other matters hereunder whether based upon contract, tort or any other theory including negligence.
PK Software Service GmbH's entire liability, without exception, is limited to the customers' reimbursement of the purchase price of the Software (maximum being the lesser of the amount paid by you and the suggested retail price as listed by PK Software Service GmbH) in exchange for the return of the product, all copies, registration papers and manuals, and all materials that constitute a transfer of license from the customer back to PK Software Service GmbH.
Warranties
Except as expressly stated in writing, PK Software Service GmbH makes no representation or warranties in respect of this Software and expressly excludes all other warranties, expressed or implied, oral or written, including, without limitation, any implied warranties of merchantable quality or fitness for a particular purpose.
Governing Law
This Agreement shall be governed by the law of the Germany applicable therein. You hereby irrevocably attorn and submit to the non-exclusive jurisdiction of the courts of Germany therefrom. If any provision shall be considered unlawful, void or otherwise unenforceable, then that provision shall be deemed severable from this License and not affect the validity and enforceability of any other provisions.
Termination
Any failure to comply with the terms and conditions of this Agreement will result in automatic and immediate termination of this license. Upon termination of this license granted herein for any reason, you agree to immediately cease use of Solar4Car.com/TeslaSolarCharger and destroy all copies of Solar4Car.com/TeslaSolarCharger supplied under this Agreement. The financial obligations incurred by you shall survive the expiration or termination of this license.
Disclaimer of Warranty
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. THIS DISCLAIMER CONCERNS ALL FILES GENERATED AND EDITED BY PK SOFTWARE SERVICE GMBH AS WELL.
IN ADDITION, NO LIABILITY OR WARRANTY IS ASSUMED FOR ANY POTENTIAL DAMAGE TO THE USED CHARGING INFRASTRUCTURE, INCLUDING THE VEHICLE, UNLESS SUCH DAMAGE RESULTS FROM INTENTIONAL MISCONDUCT.
FURTHERMORE, NO GUARANTEE IS MADE REGARDING THE ACCURACY OR COMPLETENESS OF THE DATA PROVIDED BY THE SOFTWARE, INCLUDING BUT NOT LIMITED TO PHOTOVOLTAIC SYSTEM OUTPUT, VEHICLE DATA, ENERGY CONSUMPTION (KWH), PRICING INFORMATION, OR ANY OTHER DATA. USERS ARE RESPONSIBLE FOR VERIFYING THE ACCURACY AND RELIABILITY OF SUCH INFORMATION BEFORE MAKING DECISIONS BASED ON IT.
Constent of use of data
You agree that PK Software Service GmbH may collect and use information gathered in any manner as part of the product support services provided to you, if any, related to TeslaSolarCharger/Solar4Car.com. PK Software Service GmbH may also use this information to provide notices to you which may be of use or interest to you.
License and Pricing
All licenses, features, and content associated with the Service may change at any time, at our sole discretion.
Pricing structures are subject to modification without prior notice. Users will be charged according to the rates in effect at the time of service usage.
Updated licenses, features, or prices will be published on this website. Your continued use of the Service after any changes constitutes acceptance of the updated terms.
We reserve the right to terminate or suspend accounts found in violation of this Policy without prior notice. Serious or repeated breaches may result in permanent restrictions on Service access.
